Not All Overtime Qualifies for Tax Free Treatment

Only federal FLSA overtime (hours over 40 in a workweek) qualifies for the OBBBA deduction. Overtime required by state law, union contracts, or employer policy that goes beyond what the FLSA requires does not qualify. If you simply divide your total overtime pay by 3, you may be overclaiming. The standard accuracy penalty is 20% of the underpaid tax.
